Mauricio Macri criticized the appointment of judges to the Supreme Court by decree with self-criticism: "Experience tells me that it is not correct"

First he gathered his party, then he let the majority position be known and finally, at the last hour of this Wednesday, Mauricio Macri decided to express his criticism of the appointment of judges Ariel Lijo and Manuel García-Mansilla to the Supreme Court, by means of a decree and in commission, as decided by the President.
The former president did so with self-criticism. "Empirical experience tells me that the appointment of judges through a mechanism like the one used by the government is not correct," he wrote on his X account. He did not need to clarify that he was referring to his own backtracking when he tried to appoint Horacio Rosatti and Carlos Rosenkrantz - today judges of the highest court - through the same means as Javier Milei.
He then went on to present his personal position and his rejection, in particular, of the incorporation of Ariel Lijo. "I reaffirm my position that judges who occupy the highest positions in the Judicial Branch cannot be the object of so much rejection."
"Trust in justice and institutions is an indispensable condition for the stability of democracy and the prosperity of the country. My position is the majority position within the PRO, as reflected in the report produced by the Pensar Foundation," Macri said.

In his late post, the founder of PRO added a publication from the Macri think tank, critical of the appointment process and the candidates chosen by the libertarian administration. It is an article by Martín Casares , general secretary of the Public College of Lawyers of the Federal Capital and consultant of Pensar, who in his defense stated: "Given the role of the magistrates and their obligation to decide impartially, it is essential to guarantee their judicial independence through stability in office."
In this context, the lawyer stated: "The appointment on commission by the Executive Branch compromises this independence , since the interim judges depend on the subsequent approval of the Executive and the Senate, which affects their ability to issue sentences with complete independence and erodes the principle of separation of powers ."
Casares also said that “the appointment of judges by decree has a negative impact on legal security and public confidence.”
"This constitutionally permitted solution is not desirable, and in my opinion it would bring negative consequences for the Government and the judiciary," added the lawyer, who maintained that the ruling party's measure " will affect the credibility of the Supreme Court."
